The practice of sanctioning administrative violations in legal proceedings shows that acts of obstructing legal proceedings are increasing, making it difficult for the case to be resolved, and negatively affecting the quality of the case settlement of competent agencies and persons, the sanctity and authority of the judiciary.

The promulgation of a unified and detailed legal document, creating a legal basis for strictly handling acts that obstruct the procedural activities of competent agencies and persons; strengthen discipline and discipline in the proceedings and the sense of law observance, to prevent possible violations; raise the prestige of state agencies, ensure the sanctity of the courts, and ensure the respect of individuals, agencies and organizations for the procedure-conducting agencies; creating conditions for solving cases quickly, effectively and legally.

The Ordinance on Sanctioning of Administrative Violations for Acts of Obstructing Legal Procedures (Ordinance) consists of 4 chapters and 48 articles; come into effect from September 1, 2022. Accordingly, the maximum fine for each act of obstructing legal proceedings of an individual is VND 40 million and an organization is VND 80 million.
